Since there are no laws prohibiting the use, manufacture or sale of these fake drugs, policing is problematic for law enforcement officials as a person can only be charged for an offense that was a recognized criminal offense at the time of the alleged conduct. As a direct result of this, the legal buffer that could have been a protective barrier for users is rendered useless. This means that the risks of physiological and psychological damage will increase as well since there will not be any measures to control the use of these drugs.

Drug testing kits that test for drug purity and identity are now the only real hope for the scourge that is threatening to worsen the drug problem in America.
